RICK & LISA BRIGGS’ VILLA TERMS AND CONDITIONS
The signing of the booking form by the party leader(s) confirms acceptance of the terms and conditions set out and shall be binding on the person(s) listed on the booking form intending to occupy the premises (or any subsequent amendments to this list). No party leader of group(s) who is under the age of 21 will be accepted. No pets allowed under any circumstances in any of our villas. Do not sneak animals of any kind into our homes, or you will be charged a fine if any evidence of animal reminisces is detected. If caught you will be fined and asked to leave your villa immediately. (Unfortunately these conditions are strictly put in place due to past guests violating rules.)
For the comfort of guests, all homes are No smoking, NO PET villas. Smoking is permitted outside on the pool deck (ONLY). If these conditions are not adhered to there will be an administrative charge anywhere from $300-$1000 to get the home in the best possible condition for our next guest. If there is any type of malicious damage that cannot be deemed accidental then the party will be charged accordingly.
To ensure comfort, security and peace of mind our home is registered with the state authorities and is in full compliance with all relevant legislation.
The villa has a check-in time of 4:00pm local time on the day of arrival and is to be vacated by 10:00am local time date on the morning of departure. Vacating after 10:00am will incur a charge equivalent to one day accommodation cost unless previously agreed with the owner. Guests can arrange early check-in & late check out at time of booking (extra fees may apply). We will do our best to accommodate all requests.
The completion of booking form, a non- refundable booking deposit of $200 is required immediately to secure your booking and is applied to the total amount due. Upon receipt of your deposit we will send you confirmation of your booking. Payment of the balance is due 8 weeks prior to your arrival date. Once full payment is complete, we will send you directions to the property, alarm and lock box numbers for the villa, within 10 days before your arrival dates. Please be sure about your booking dates, because the booking deposit is not refundable.
The villa rental is priced in US dollars per day/week. The minimum night stay is 3 nights. The rental charge includes electricity, water, air conditioning, water, air conditioning, telephone (Free calls to USA/CANADA), cable television and wireless internet. Two sets of bed linen and towels are provided. A thorough clean of the villa is carried out before and after each occupant. THIS IS A SELF-CATERING VACATION HOME. Bookings of less than 7 nights incur a cleaning charge of $85 (3 bedroom), $95 (some 3s, 4 bedroom) & $120 charge (5 bedroom). There is also a one-time booking fee of $40.
Self catering means that the homeowner only supplies a limited amount of necessities such as a toilet paper roll in every bathroom, soaps for each bathroom sink, a paper towel roll and 2 large garbage bags. These are just to get you started, but any additional supplies have to be supplied by the guest. There may be other items in the villa when you arrive such as dishwasher and laundry soap, more garbage bags etc, but these will have been left by the previous guests and we leave them in the villa for your convenience.
If pool heating is purchased, the management company will turn on the heater prior to arrival. Pool heating is highly-recommended from October to April. The cost of pool heating is $25 per day, pools with spas or gas heating is $35 per day. It is important to note that pool heating does take 24-48 to reach its full temperature of warmth.
NOTE: Pool heater may not work if temperature outside drops below 55 degrees; unfortunately we have no control over the weather and ACTS OF MOTHER NATURE. A refund will not be provided for pool heat if weather is unfavorable, because the system is still running and using electricity. Also there is no refund if the equipment becomes inoperable due to the weather conditions.
The party leader is solely responsible for any damages or breakages that may be caused to the property or its contents during your stay. We require a $300 refundable security/damage deposit to be paid with your balance prior to travel. This deposit will be repaid to your party by check/PayPal/credit card hold release, as soon as the management company has reported no damages and that you have returned the keys. Our local management company checks the home before your arrival and after your departure and will advise us of any faults. This may include additional cleaning costs for removal of stains due to spillages, stains or smoking odors. We reserve the right to retain the security deposit (either in part or full) to cover any damages or non- return of keys. Receipts for repairs / replacements will be provided in the unlikely event that such retention of the security deposit is required. We reserve the right to pursue a guest for expenses associated with any and all damages caused which may exceed the value of the security deposit and will require payment within 14 days of being served notice of this. Florida has a sub tropical climate and care must be taken with food that is left uncovered. Uncovered food can attract insects very quickly. Any added cost for pest control services incurred for lack of care may be passed to you.
ACCIDENTAL DAMAGE INSURANCE
We also require our guests accidental damage insurance for our homes. We will send you a link to purchase this policy on your own behalf for the following prices of $49 which covers $1,500 of accidental ONLY damage. If you would to upgrade to a higher policy of $69 (covers $3,000) or $89 (covers $5,000), please let us know. Be Aware, this is a onetime charge that only covers damage deemed "accidental only." Please report any damage to the owner or Management Company as soon as possible. Do not be afraid to report, this is what the coverage is intended for. There will still be a credit card hold to cover theft, loss late or early check-in/out, damage that is not deemed accidental or any other issues.
CANCELLATION BY GUESTS
In the event of your party needing to cancel, it must be made in writing and the following conditions will apply:
· 61 days or more a full refund (except for a non- refundable booking deposit of $200)
· 31-60 days prior to departure 50% loss of the total booking is held to offset the discount that we will need to re-book the property at short notice
· 15-30 days prior will regrettably result in loss of 75% of the whole booking
· 0-14 days prior, including no shows will regrettably result in loss of 100% of whole booking
· Failure to pay the final balance by the due date, 60 days prior, will result in loss of non- refundable booking deposit of $200. If we do not receive the payment we will endeavor to contact the guest but if we receive no payment or communication, then unfortunately we reserve the right to cancel the booking and retain the deposit. If you do have a problem, PLEASE contact us as soon as possible to discuss the matter.
We recommend that all guests take out holiday, injury, medical and cancellation insurance to cover you during your vacation. Accidental Damage Insurance does not cover medical, injury, trip interruption or cancellation.
All cancellations must be confirmed in writing.
CANCELLATION BY THE OWNERS
In the unlikely event that personal circumstances necessitate cancellation of the booking we will refund any monies paid by the party (without interest, compensation or consequential loss of any kind). However the management company will always seek to relocate your booking first to a villa of a similar or superior standard.
Force Majeure: The owners and their agents accept no responsibility or liability for any loss or damage or alterations to the terms of this booking caused by events beyond the owners control including, but not restricted to, war, civil commotion, flight delays or cancellations, technical difficulties with transportation, alteration or cancellation or schedules by carriers, adverse weather conditions, fire, flood, industrial dispute or any other event beyond our control.
SAFETY & SECURITY
To comply with state fire regulations under no circumstances may more than the maximum number of persons identified on the booking form occupy the property. The swimming pool is used entirely at the guest’s own risk. No diving is allowed and children must be supervised at all times whilst in the pool area. Glass is not permitted in the pool area at any time. Please use the plastic items provided.
In the unlikely event of a problem arising whilst you are on holiday (relating to our villa) you should immediately contact us or our management company who will seek to resolve the matter speedily. Your satisfaction with our villa is paramount to us and should you consider that the matter is not resolved, we ask you to contact us directly.
LIABILITY – The property is privately owned and neither the owners nor the management personnel accept any responsibility whatsoever for personal injury, accidents, loss or damage to persons or personal effects, however caused.
The owners and their agents and management company reserves the right of entry at any time. (This includes scheduled maintenance workers for repair issues).
